Trump Signs Executive Order Targeting Flag Burning Despite Supreme Court Protection

President Donald Trump has issued an executive order directing the Justice Department to investigate and prosecute individuals who burn the American flag—a practice the US Supreme Court has recognized as constitutionally protected political expression.

The order, signed Monday in the Oval Office, acknowledged the Supreme Court’s 5-4 ruling in a 1989 Texas case, which affirmed that flag burning is covered by the First Amendment. However, Trump argued that prosecutions could still proceed if flag burning is “likely to incite imminent lawless action” or constitutes “fighting words.”

Speaking at the signing, Trump claimed that flag burning sparks unprecedented riots and widespread outrage. While he did not provide specific examples, he described the act as inciting chaos among bystanders and provoking anger.

The text of the executive order characterizes flag desecration as a uniquely offensive and provocative act—a “statement of contempt, hostility, and violence against our Nation” that threatens public order. Trump said the act demonstrates opposition to the political union safeguarding American rights and security, and argued that it can provoke violence.

Under the order, individuals convicted of flag burning could face up to one year in prison without the possibility of early release. Foreign nationals who engage in the act may see visas, residency permits, naturalization processes, and other immigration benefits revoked, and could face deportation.

Trump also criticized the Supreme Court ruling protecting flag burning, calling it a “very sad court.” He said, “I guess it was a 5-to-4 decision. They called it freedom of speech. But there’s another reason, which is perhaps much more important. It’s called death.” He added that large gatherings witnessing flag burning can result in chaos and disorder.

The order is part of the administration’s broader effort to assert stricter penalties for what Trump describes as acts that disrespect the American flag, framing it as a measure to restore its dignity and symbolic sanctity.
